Driver reinstated after arrest based on domestic incident

In Taxi & Limousine Comm’n v. Jean Louis, the ALJ recommended reinstatement after the an Uber driver, who was respresented himself, was arrested after a domestic assault. The ALJ summarized the  undisputed evidence as establishing that driver had never been arrested before; that there had been no record of prior assaultive behavior involving passengers or members of the public; that he had provided over 16,600 rides in just over five years and had received excellent passenger ratings. The driver had also  presented persuasive evidence of his good character with childhood friends credibly describing him as nonviolent, responsible and reliable.

The minor nature of the injury, as described by the arresting officer, was consistent with a finding that the TLC’s evidence did not establish that the driver’s continued licensure would pose a direct and substantial threat to public health or safety.
